Verordnung (EU) Nr. 758/2013 der Kommission vom 7. August 2013 zur Berichtigung von Anhang VI der Verordnung (EG) Nr. 1272/2008 des Europäischen Parlaments und des Rates über die Einstufung, Kennzeichnung und Verpackung von Stoffen und Gemischen

Die Europäische Kommission -

gestützt auf den Vertrag über die Arbeitsweise der Europäischen Union,

gestützt auf die Verordnung (EG) Nr. 1272/2008 des Europäischen Parlaments und des Rates vom 16. Dezember 2008 über die Einstufung, Kennzeichnung und Verpackung von Stoffen und Gemischen, zur Änderung und Aufhebung der Richtlinien 67/548/EWG und 1999/45/EG und zur Änderung der Verordnung (EG) Nr. 1907/2006 1 , insbesondere auf Artikel 53,

in Erwägung nachstehender Gründe:

(1) Bei einer Überprüfung hat sich herausgestellt, dass die Anhänge I, II, IV und V der Verordnung (EG) Nr. 790/2009 der Kommission vom 10. August 2009 zur Änderung der Verordnung (EG) Nr. 1272/2008 des Europäischen Parlaments und des Rates über die Einstufung, Kennzeichnung und Verpackung von Stoffen und Gemischen zwecks Anpassung an den technischen und wissenschaftlichen Fortschritt 2 Fehler enthalten. Diese Fehler sind daher zu berichtigen.

(2) Die berichtigte harmonisierte Einstufung und Kennzeichnung von Stoffen und Gemischen sollte ab dem Tag des Inkrafttretens der vorliegenden Verordnung gelten. Lieferanten sollten nicht verpflichtet sein, Stoffe und Gemische, die bereits vor Inkrafttreten der vorliegenden Verordnung gemäß der Verordnung (EG) Nr. 1272/2008 in Verkehr gebracht wurden, neu zu kennzeichnen und neu zu verpacken. Allerdings sollten die Lieferanten die Möglichkeit haben, die Bestimmungen der vorliegenden Verordnung auf freiwilliger Basis auf bereits in Verkehr gebrachte Stoffe und Gemische anzuwenden.

(3) Die in dieser Verordnung vorgesehenen Maßnahmen entsprechen der Stellungnahme des mit Artikel 133 der Verordnung (EG) Nr. 1907/2006 des Europäischen Parlaments und des Rates vom 18. Dezember 2006 zur Registrierung, Bewertung, Zulassung und Beschränkung chemischer Stoffe (REACH), zur Schaffung einer Europäischen Chemikalienagentur, zur Änderung der Richtlinie 1999/45/EG und zur Aufhebung der Verordnung (EWG) Nr. 793/93 des Rates, der Verordnung (EG) Nr. 1488/94 der Kommission, der Richtlinie 76/769/EWG des Rates sowie der Richtlinien 91/155/EWG, 93/67/EWG, 93/105/EG und 2000/21/EG der Kommission 3 eingesetzten Ausschusses

- hat folgende Verordnung erlassen:

Artikel 1

In Anhang VI Teil 3 der Verordnung (EG) Nr. 1272/2008 werden die Einträge in der durch die Anhänge I und II der Verordnung (EG) Nr. 790/2009 geänderten Tabelle 3.1, die den Einträgen in Anhang I der vorliegenden Verordnung entsprechen, durch die Einträge in diesem Anhang ersetzt.

Artikel 2

In Anhang VI Teil 3 der Verordnung (EG) Nr. 1272/2008 werden die Einträge in der durch die Anhänge IV und V der Verordnung (EG) Nr. 790/2009 geänderten Tabelle 3.2, die den Einträgen in Anhang II der vorliegenden Verordnung entsprechen, durch die Einträge in diesem Anhang ersetzt.

Artikel 3

Die Einträge in Anhang III der vorliegenden Verordnung werden der Tabelle 3.1 in Anhang VI Teil 3 der Verordnung (EG) Nr. 1272/2008 hinzugefügt.

Artikel 4

Die Einträge in Anhang IV der vorliegenden Verordnung werden der Tabelle 3.2 in Anhang VI Teil 3 der Verordnung (EG) Nr. 1272/2008 hinzugefügt.

Artikel 5

Lieferanten sind nicht verpflichtet, in den Anhängen der vorliegenden Verordnung aufgeführte Stoffe oder diese Stoffe enthaltende Stoffe und Gemische, die bereits vor Inkrafttreten der vorliegenden Verordnung gemäß der Verordnung (EG) Nr. 1272/2008 in den Verkehr gebracht wurden, neu zu kennzeichnen und neu zu verpacken.

Artikel 6

Diese Verordnung tritt am dritten Tag nach ihrer Veröffentlichung im Amtsblatt der Europäischen Union in Kraft.

Diese Verordnung ist in allen ihren Teilen verbindlich und gilt unmittelbar in jedem Mitgliedstaat.
