Im Internationalen Code für den Bau und die Ausrüstung von Schiffen zur Beförderung gefährlicher Chemikalien als Massengut (IBC-Code) in Kapitel 17 und 18 sind die Produkte eingetragen, deren Verschmutzungswirkung durch die GESAMP/ESPH Gruppe abschließend bewertetet wurde und für die auf dieser Grundlage Transportgenehmigungen erteilt werden können.

Bisher nicht abschließend bewertete Produkte, die als Massengut befördert werden sollen, werden nach einem durch die IMO festgelegten Verfahren vorläufig bewertet. Auf dieser Grundlage kann eine dreiseitige Vereinbarung ("Tripartite Agreement") über die Transportanforderungen geschlossen werden.

Das neue Rundschreiben mit der Liste der Produkte mit vorläufiger Einstufung ist am 1. Januar 2020 in Kraft getreten. Es wird nachfolgend veröffentlicht.

1 Einleitung

Dieses Rundschreiben wird nach Maßgabe von Regel 6 Absatz 3 der Anlage II von MARPOL herausgegeben und ersetzt alle früheren Rundschreiben unter dieser Überschrift.

2 Liste der Anlagen

2.1 Das Rundschreiben umfasst die folgenden Anlagen:

Anlage 1: Liste 1: Reine oder technisch reine Produkte und Gemische, die als Ganzes bewertet werden;

Anlage 2: Liste 2: Nur verschmutzende Gemische, die mindestens 99 % in Gewicht bereits von der IMO bewertete Bestandteile enthalten;

Anlage 3: Liste 3: Gemische (mit Handelsbezeichnung), die mindestens 99 % in Gewicht bereits von der IMO bewertete Bestandteile mit Sicherheitsgefahren enthalten;

Anlage 4: Liste 4: Nur verschmutzende Gemische mit einem oder mehreren noch nicht von der IMO bewerteten Bestandteilen, der beziehungsweise die mehr als 1 % in Gewicht des Gemischs ausmacht beziehungsweise ausmachen;

Anlage 5: Liste 5: Stoffe, die nicht in reiner Form, sondern als Bestandteile in Gemischen befördert werden;

Anlage 6: Synonyme für Pflanzenöle;

Anlage 7: Länderabkürzungen;

Anlage 8: Kontaktadressen dreiseitige Vereinbarungen;

Anlage 9: Hersteller, die befugt sind, Bewertungen nur verschmutzender Stoffe durch Berechnung vorzunehmen;

Anlage 10: Zusätze zur Reinigung von Ladetanks

Anlage 11: nach den Richtlinien von 2011 für die Beförderung von Gemischen aus Erdöl und Biokraftstoffen anerkannte Biokraftstoffe.

Anlage 12: Energiereiche Kraftstoffe gemäß Anlage I, MARPOL.

2.2 Die Anlagen 1 bis 5 enthalten Listen schädlicher flüssiger Stoffe (NLS) (oder Produkte, wie sie im Folgenden bezeichnet werden) nach Gruppen geordnet mit den ihnen zugewiesenen Beförderungsanforderungen, die von der ESPH-Arbeitsgruppe des Unterausschusses für die Verhütung und Bekämpfung der Meeresverschmutzung (PPR) bewertet und bestätigt oder die im Rahmen dreiseitiger Vereinbarungen festgelegt und der Organisation nach Maßgabe von Regel 6 Absatz 3 der Anlage II von MARPOL mitgeteilt wurden. Die Anlagen 6 bis 8, 11 und 12 sollen die Meldung von dreiseitigen Vereinbarungen und das Verständnis der in den Anlagen 1 bis 5 verwendeten Abkürzungen erleichtern.

3 Anmerkungen zu den Anlagen Produktlisten (Anlagen 1 bis 5)

3.1 Bei der Mehrheit der in diesem Rundschreiben enthaltenen Produkte handelt es sich um Stoffe mit Handelsbezeichnungen. Da die Handelsbezeichnungen nicht übersetzt werden, sind diese Produkte exakt so eingetragen worden, wie sie der Organisation gemeldet wurden, und die Listen werden nur in Englisch herausgegeben.

3.2 Dieses Rundschreiben umfasst folgende Änderungen der im vorhergehenden Rundschreiben (d.h. MEPC.2/Circ.24) enthaltenen Angaben:

  1. jegliche neue Produkte, Gemische mit Handelsbezeichnungen und Reinigungszusätze, die im laufenden Jahr von der ESPH-Arbeitsgruppe bewertet worden sind;
  2. Änderungen bestehender Produkteinträge in den Produktlisten und
  3. neue Produkteinträge, die unter neue an die Organisation seit MEPC.2/Circ.24 gemeldete dreiseitige Vereinbarungen fallen.

3.3 Änderungen in den Produktlisten (Anlagen 1 bis 5) gegenüber der vorherigen Ausgabe MEPC.2/Circ.24 sind durch Schattierung des Feldes, in dem eine Änderung vorgenommen wurde, kenntlich gemacht.

3.4 In bestimmten Fällen können Produkte aus folgenden Gründen aus den Produktlisten gestrichen worden sein:

  1. Es sind Änderungen an den Produktnamen vorgenommen worden (Produkte mit Handelsbezeichnungen);
  2. Entfernung von Produkten, die nicht mehr hergestellt oder befördert werden (Produkte mit Handelsbezeichnungen) oder
  3. Einträge, die unter dreiseitige Vereinbarungen fielen und deren Ablaufdatum erreicht wurde, die jedoch nicht innerhalb des in der dreiseitigen Vereinbarung genannten Zeitraums bewertet wurden.

3.5 Ungeachtet des Vorstehenden gelten bei Ablaufen einer dreiseitigen Vereinbarung oder Änderung von Beförderungsanforderungen für ein Produkt vom vorherigen zum neuen Rundschreiben während der Beförderung einer Sendung die zum Zeitpunkt der Verladung geltenden Beförderungsanforderungen.

3.6 Die Kennzeichnung eines Produktes mit einem Sternchen (*) weist darauf hin, dass auf Grundlage von Experteneinschätzungen bei der Bestimmung gewisser Beförderungsanforderungen von den in Kapitel 21 des IBC-Codes festgelegten üblichen Kriterien abgewichen wurde.

3.7 Die Festlegung der Art von Produkten der Liste 1, wie im vorliegende Rundschreiben enthalten, entspricht der Festlegung der Art von Produkten, die in den Kapiteln 17 und 18 des IBC-Codes enthalten sind. Die in dieser Liste enthaltenen Produkte fallen entweder unter eine dreiseitige Vereinbarung und haben ein Ablaufdatum, d.h. sie wurden bislang weder bewertet, noch wurden ihre Beförderungsanforderungen bestätigt, oder es wurden nach der letzten Reihe von Änderungen des IBC-Codes Änderungen an ihren Beförderungsanforderungen vorgenommen.

Solche Produkte werden im Rahmen der nächsten Änderung ordnungsgemäß in den IBC-Code aufgenommen und entsprechend aus Liste 1 gestrichen. Die übrigen Produktlisten (Anhänge 2 bis 5) entsprechen keinen Listen im IBC-Code und die Einträge dieser Listen verbleiben im Rundschreiben vorbehaltlich der Bestimmungen im vorstehenden Absatz 3.3.

3.8 Fußnoten zu Einträgen in Liste 1 (in Klammern nach dem Produkteintrag) dieses Rundschreibens sind am Ende von Kapitel 17 des IBC-Codes erläutert.

Länder- und Gebietscodes (Anlage 7)

3.9 Die Liste von Länder- und Gebietsabkürzungen entspricht derjenigen, die im Globalen Integrierten Schifffahrtsinformationssystem (GISIS) verwendet wird - dem System, das die Organisation als Speicherort für alle erhaltenen Produktinformationen und Entscheidungen bezüglich der Zuweisung von Gefährdungsprofilen (von GESAMP/EHS) und Beförderungsanforderungen (der ESPH-Arbeitsgruppe) zu den einzelnen Produkten einsetzt.

3.10 Diese Codes beruhen auf dem einheitlichen UN/LOCODE-System, bei dem es sich um ein geographisches Codeschema handelt, das die Wirtschaftskommission der Vereinten Nationen für Europa (UNECE) - eine Organisation der Vereinten Nationen - erarbeitet hat und fortschreibt. Die Codes sind in Anlage 7 aufgeführt. Teil 1 der Anlage 7 enthält die Länderkürzel des Codes in alphabetischer Reihenfolge, während in Teil 2 die Länder/ Gebiete alphabetisch aufgelistet sind.

Zusätze zur Reinigung von Ladetanks (Anlage 10)

3.11 Die Anlage II von MARPOL legt Grenzwerte für das Einleiten von schädlichen flüssigen Stoffen fest und enthält Einschränkungen hinsichtlich der Reinigungszusätze, die bei Tankwaschverfahren eingesetzt werden können.

3.12 Alle in diesem Rundschreiben aufgeführten Reinigungszusätze (Anlage 10) sind von der ESPH-Arbeitsgruppe in Übereinstimmung mit dem Überarbeiteten Leitfaden für Ladetankreinigungszusätze und Meldeblatt (MEPC.1/Circ.590) bewertet worden und erfüllen die Anforderungen von Regel 13.5.2 der Anlage II von MARPOL.

3.13 Werden Produkte oder ihre Lösungen, die in Kapitel 17 oder 18 des IBC-Codes oder in Liste 1 dieses Rundschreibens enthalten sind, als Waschmittel verwendet, so unterliegt ihre Einleitung Regel 13.5.1 der Anlage II von MARPOL. Als solche müssen sie nicht in Anlage 10 dieses Rundschreibens aufgeführt sein.

In Biokraftstoff/Erdölgemischen verwendete Biokraftstoffe (Anlage 11)

3.14 Anlage 11 enthält die Liste zugelassener Biokraftstoff/Erdölgemische, die Gegenstand der Richtlinien von 2019 für die Beförderung von Gemischen aus Erdöl und Biokraftstoffen (MEPC.1/Circ.761/Rev.1) sind.

3.15 Anlage 12 enthält die Liste anerkannter, energiereicher Kraftstoffe, die Gegenstand der Richtlinien für den Transport energiereicher Brennstoffe

4 Unterrichtung über neuer Einträge im Rahmen dreiseitiger Vereinbarungen

4.1 Die Richtlinien für die vorläufige Bewertung von flüssigen Stoffen, die als Massengut befördert werden, sind in MEPC.1/Circ.512 aufgeführt. Bei der Unterrichtung der Organisation über vorläufige Bewertungen im Rahmen einer dreiseitigen Vereinbarung sind die Behörden aufgefordert,

  1. die Liste anzugeben, in die der Produkteintrag aufgenommen werden soll und
  2. alle sachdienlichen Angaben zu machen, die in das Rundschreiben aufzunehmen sind.

4.2 Zur weiteren Unterstützung der Länder bei der Bestimmung der Beförderungsanforderungen für Produkte als Massengut wurde eine Zusammenfassung der "References to related Information and recommendations for ascertaining the carriage requirements for products ship ped in bulk" (Verweise auf sachdienliche Informationen und Empfehlungen für die Ermittlung der Beförderungsanforderungen für als Massengut beförderte Produkte) auf der IMO-Webseite veröffentlicht; diese Zusammenfassung kann unter

4.3 Da die Mehrzahl der der Organisation gemeldeten Produkte mit Hilfe der "Berechnungsmethode" (siehe MEPC.1/Circ.512/Rev.1) klassifiziert wird und sie somit Anwärter für die Aufnahme in Liste 2 sind, ist es besonders wichtig, dass der Organisation diese Angaben in einem Format übermittelt werden, das eine wirksame und genaue Überführung in die Datenbank erleichtert, die zur Erstellung der diesem Rundschreiben beigefügten verschiedenen Listen verwendet wird.

4.4 Für Produkte der Liste 2 sollen die Angaben vorzugsweise in folgendem Format übermittelt werden:

4.5 Bei Stoffen, die in die Listen 1, 3 oder 4 aufgenommen werden sollen, wird das in Anhang 6 der Anlage zu MEPC.1/Circ.512/Rev.1 aufgeführte Format vorgezogen.

4.6 Gehen unvollständige Angaben zu einem Produkt ein, verzögert sich die Einreichung, während der Antrag zur weiteren Überarbeitung zum Absender zurückgeschickt wird.

4.7 Unter Hinweis darauf, wie wichtig die Weitergabe korrekter Angaben an die Organisation ist, muss besonders unterstrichen werden, dass bei Vorschlag eines Produkts für die Listen 2 und 4 der für das größte Verschmutzungspotential verantwortliche Bestandteil nach dem Wort "enthält" in der Beförderungsbezeichnung näher anzugeben ist. Dieser wird als die "enthält-Bezeichnung" bezeichnet. Es handelt sich hierbei um den Bestandteil mit dem höchsten bei der Berechnungsmethode ermittelten Wert. Für den Fall, dass es mehrere Bestandteile mit gleich hohen Werten gibt, ist zu entscheiden, ob ein Bestandteil oder beide Bestandteile in der "enthält-Bezeichnung" angegeben werden sollen. Die für den Bestandteil beziehungsweise die Bestandteile verwendete Bezeichnung soll diejenige sein, die in Kapiteln 17 oder 18 des IBC-Codes oder in den Listen 1 bis 5 dieses Rundschreibens aufgeführt ist.

4.8 Es ist ebenfalls darauf hinzuweisen, dass jeder zur Beförderung als Massengut vorgesehene schädliche flüssige Stoff im Beförderungsdokument mit der Produktbezeichnung gekennzeichnet sein muss, unter der dieser in Kapitel 17 oder 18 des IBC-Codes oder der neuesten Ausgabe dieses Rundschreibens aufgeführt oder unter dem er im Rahmen einer dreiseitigen Vereinbarung vorläufig eingestuft worden ist. In diesem Zusammenhang ist BLG.1/Circ.17 betreffend die Verwendung der offiziellen Benennung für die Beförderung flüssiger Ladung als Massengut besonders zu beachten sowie BLG.1/Circ.25, das sich mit der Verwendung spezifischer Produktbezeichnungen anstelle von Gattungseintragungen beschäftigt, in Fällen, in denen beide Optionen für die Beschreibung von flüssiger Ladung als Massengut möglich sind.

4.9 Bei Beförderung eines Gemischs, das nur unter Verschmutzungsgesichtspunkten eine Gefahr darstellt (Stoffe der Liste 2 oder Liste 4), würde der entsprechende n.a.g.-Eintrag im IBC-Code zusammen mit der Handelsbezeichnung und den "Produkt enthält"-Angaben die offizielle Benennung für die Beförderung darstellen. Wenn zum Beispiel die Handelsbezeichnung IMO 1234 lautet und "Calcium long-chain alkyl salicylate (C13+)" als Bestandteil mit dem größten Verschmutzungspotential enthalten ist, könnte die richtige Produktbezeichnung wie folgt lauten:

4.10 Der Kapitän eines Schiffes des Typs 2, das für die Beförderung von n.a.g- Produkten zugelassen ist, würde dann wissen, dass er die Ladung ohne Befürchtungen hinsichtlich Feuer, Toxizität und anderen Sicherheitsrisiken annehmen kann und dass er im Fall eines unfallbedingten Austretens die Bezeichnung des für die Verschmutzung verantwortlichen Stoffes an die Küstenstaatenbehörden melden könnte.

4.11 Bei der Beförderung von Gemischen (mit Handelsbezeichnungen), d. h. Gemischen mit Handelsbezeichnungen, die mindestens 99 % in Gewicht bereits von der IMO bewertete Bestandteile mit Sicherheitsrisiken enthalten (Stoffe der Liste 3), würde die Handelsbezeichnung und "Produkt enthält"-Angabe die offizielle Benennung für die Beförderung darstellen. Wenn zum Beispiel die Handelsbezeichnung XYZ 4567 lautet und der Stoff "hydrochloric acid" als Bestandteil mit dem größten Verschmutzungs- oder Sicherheitsgefahrenpotential enthält, würde die richtige Produktbezeichnung wie folgt lauten:

5 Dreiseitige Kontaktadressen

5.1 Nach Maßgabe der Entschließung MEPC.109(49) über dreiseitige Vereinbarungen sollen für Verwaltungen, die der Organisation ihre neuesten Kontaktdaten nicht mitgeteilt haben, die dreiseitigen Vereinbarungen als angenommen gelten, während andere Kontaktstellen immer noch Regel 6 Absatz 3 der Anlage II von MARPOL befolgen sollen.

5.2 Die Verwaltungen werden daher aufgefordert, ihre jeweiligen in Anlage 8 zu diesem Rundschreiben aufgeführten Kontaktinformationen zu prüfen und mögliche Fehler oder Auslassungen zu korrigieren.

5.3 In diesem Zusammenhang ist darauf hinzuweisen, dass die Kontaktstellen für dreiseitige Vereinbarungen über die GISIS-Datenbank (https://gisis.imo.org) zur Verfügung stehen und dass möglicherweise erforderliche Änderungen von der betroffenen Verwaltung direkt in der Datenbank vorgenommen werden können.

Annex 11 - BIOFUELS RECOGNIZED UNDER THE 2011 GUIDELINES FOR THE CARRIAGE OF BLENDS OF PETROLEUM OIL AND BIOFUELS

The following have been agreed as recognized biofuels in accordance with the 2011 Guidelines for the carriage of blends of petroleum oil and biofuels (MEPC.1/Circ.761/Rev.1):

  1. tert-Amyl ethyl ether*
  2. Ethyl alcohol
  3. Fatty acid methyl esters (FAME) †
  4. Vegetable oils

*) With regard to the shipment of blends of petroleum oil and any of these products under MARPOL Annex II controls, it is necessary to initiate or refer to tripartite agreements for such blends indicating the carriage requirements as appropriate.
†) This entry is intended to include any specific FAMEs set out in chapter 17 of the IBC Code or the MEPC.2/Circular

  2. Alkanes (C5-C7), linear and branched
  3. Alkanes (C9-C24) linear, branched and cyclic with a flashpoint < 60°C
  4. Alkanes (C9-C24) linear, branched and cyclic with a flashpoint > 60°C
  5. Alkanes (C10-C17), linear and branched
  6. Alkanes (C10-C26), linear and branched with a flashpoint < 60°C
